The rights and duties of foreigners in Catalonia and the administrative procedures necessary to legalise their presence in the country are governed by the Llei d'estrangeria or Immigration Law (Constitutional Law 4/2000 of 11 January on the rights and freedoms of foreigners and their social integration), as well as by the regulations (Royal Decree 557/2011 of 20 April) that expand on that law.

The rules on foreigners mentioned above apply to the whole of Spain. However, there are certain issues that are the responsibility of the Catalan government, resulting in the approval of Decree 188/2001 of 26 June on foreigners and their social integration in Catalonia.

The legislation in question applies to foreigners who are not European Community nationals, i.e. those not covered by the Community system applicable to citizens of the European Union, the European Economic Area (Norway, Iceland and Liechtenstein) and the Swiss Confederation. The Community system also applies to:

  • Their spouse, non divorced or having agreement or marriage nullity declaration or unmarried spouse recorded in public record.

  • Theirs descendants or spouse, non divorced or having agreement or marriage nullity declaration.

  • Their parents or spouse of these nationals, no divorced or having agreement or marriage nullity declaration.
