The owner of a home may decide to sell it at any time, even if there is a tenant living in it.

In such cases, the tenant is given first option to buy the home, an entitlement known as a preferential purchase right (Dret d'adquisició preferent). However, there are 4 sets of circumstances in which that right does not apply:

a) If a whole building belongs to a single owner and they decide to sell it in its entirety.
b) If all the owners of property in a building decide to sell it to a single buyer.
c) If a home has more than one owner, in which case its co-owner is given preference.
d) If there is a record in the land registry of a preferential right having been granted to another person before the rental contract was signed.
